WA: Preparing for the new security of payment laws

New legislation will come into effect in Western Australia relating to construction contracts entered into on or after 1 August 2022.

The Building and Construction Industry (Security of Payment) Act 2021 provides important payment protections for all participants in the WA building and construction industry (some exclusions apply).

A range of educational material has been developed by Building and Energy to prepare you for these new laws, and to help you understand how and when the Act will apply to your construction contracts. These materials are suitable for subcontractors, head contractors, builders and suppliers.

The Construction (Former Provisions) Contracts Act 2004 will continue to apply to contracts entered into prior to this date.
